Terms of Service

These Terms of Service govern your use of the Primera Views website and services. By creating an account, uploading content or purchasing a service, you agree to them.

1. Your content stays yours

You retain all ownership of the photos, videos, logos, text and other materials you submit to Primera Views ("Customer Content"). Nothing in these Terms transfers ownership of your Customer Content to us.

2. Your rights warranty

You confirm that you own, or hold all necessary rights, licenses, permissions and releases for, all Customer Content you submit, including any rights held by photographers, agencies, property owners, brands or individuals appearing in the content. You are responsible for obtaining those permissions. You agree to indemnify and hold Primera Views harmless from any third-party claim arising from Customer Content you did not have the right to submit.

3. Licence you grant to us

You grant Primera Views a limited, non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, adapt and transform your Customer Content solely for the purpose of providing, delivering and supporting the services you request. This licence exists only to run the service and ends when the content is deleted, except where we must retain copies for legal, accounting or backup purposes.

4. Your finished work

Once your order is paid in full, you receive the finished deliverables and may use them for your own marketing, listings, advertising, social media and internal purposes. Primera Views retains ownership of its underlying tools, workflows, presets, templates, title styles, music library and technology, which are never transferred.

5. Marketing and portfolio use

We do not publish your finished work in our portfolio, website, social media or advertising unless you give explicit permission. Permission is an optional, separate checkbox and can be withdrawn at any time by contacting us. Withdrawal applies to future use and to material we can reasonably remove.

6. AI and third-party processing

Primera Views uses artificial intelligence and third-party technology providers to process images and produce cinematic motion, along with cloud hosting, payment and email providers. Customer Content may be processed by these providers strictly to deliver your requested services. We do not sell your content and we do not authorise providers to use it for their own purposes.

7. Prohibited content

You may not submit content that infringes another party's rights, is unlawful, defamatory, deceptive, or depicts individuals without their permission where permission is required. We may refuse, remove or cancel work that breaches this section.

8. Copyright complaints

If you believe content on Primera Views infringes your rights, use our copyright and IP report form. We review every report and may remove content, suspend an account or terminate repeat-infringing accounts.

9. Payments, revisions and delivery

Prices, inclusions, revision rounds and delivery times are shown at the point of purchase or agreed in writing. Payment plans, where offered, are charged as described at checkout. Work is produced from the content you supply, and results depend on the quality of that content.

10. Service limits and disclaimers

Visualizations are marketing content. They are not surveying, GPS or navigational data and should not be relied on as an exact representation of a physical space. Services are provided on an "as is" basis to the fullest extent permitted by law, and our aggregate liability is limited to the amount you paid for the service in question.

11. Accounts and suspension

You are responsible for activity in your account. We may suspend or terminate accounts used for automated abuse, resale, rights violations or activity inconsistent with normal business use.

12. Studio fair use policy

Studio is a monthly subscription for normal self-service use by the subscribing business. Unlimited refers to self-service generations made by the account holder for that business and its own properties, locations, products and marketing. Generation activity is subject to reasonable rate limits and automated abuse protection. Subscriptions renew monthly until cancelled, and you keep access until the end of the current billing period. Studio does not include professional creative direction, human editing, bespoke sound design, custom requests or revision rounds.

13. Changes to these Terms

We may update these Terms. When we make material changes we update the version above and ask you to accept the new version before your next upload or project. Continued use after acceptance means you agree to the updated Terms.
